“New York Revises Compensation Fund, Workers’ Compensation Claims for 9/11 Victims”

On September 12, 2022, an article published in Insurance Journal, “New York Revises Compensation Fund, Workers’ Compensation Claims for 9/11 Victims.” The article summarizes that NY Governor Kathy Hochul signed several bills that will aim to support 9/11 victims and their families. Specifically, the new laws address barriers and delays in the Victim Compensation Fund and workers’ compensation claims.

The first law (Legislation S.6810/A.7425) offers a simplified alternative method for the Victim Compensation Fund awards, enabling the VCF to issue an award breakdown between economic loss and non-economic loss.

The second law (S.6812/A.7426) requires the VCF to treat all victims of the World Trade Center terrorist attack equally, without unnecessary delay, removing certain restrictions that once caused delays in the process.

A third law (S.9370/A.9922A) will provide a presumption for workers’ compensation claims for any health impairment or death of those who participated in the World Trade Center rescue, recovery, and clean-up. This bill will help those who contracted an illness or died of a certified illness get benefits.

The final bill (S.9294A/A.10416) allows any individual who participated in the World Trade Center rescue, recovery, and clean-up who became disabled between 9/11/21 and 9/11/26 to file a Workers’ Compensation claim before September 11, 2026.
