Our Municipal Disability Pension Attorneys will help you navigate the application process of applying for municipal disability benefits. New York State, New York City and many local municipalities provide disability retirement benefits to their public employees who can no longer work because of illness, accidents or other disabilities. Unfortunately, getting a pension for a disability is not as easy as filling out an application. A poorly prepared or incomplete application presented by an individual increases the likelihood that the application will be denied. Additionally, the New York retirement system reviewers are just not going to accept you or your doctor at your word. They are going to require very specific and substantial medical evidence and other substantiating documentation.

You can avoid getting off to such a poor start by seeking a qualified municipal disability retirement benefits attorney right at the start of this process. In fact, the best opportunity to guarantee a successful outcome to your case is right at the beginning by getting the help of people who are experts in the various disability pension systems and who can help you avoid all the pitfalls.

With offices in Manhattan, Brooklyn, Bronx, White Plains, Nassau, Suffolk and Eastern Suffolk, we are capable of servicing injured and sick workers across New York to receive the disability benefits they deserve. Our Municipal Disability Pension Attorneys are well versed in filing a municipal disability claim and New York municipal disability pension laws.

Disability Retirement is available to workers that can no longer perform the full duties required of their specific title. This legal standard means that you must no longer be able to perform your job, it does not require that you be disabled from all jobs in the United Sates like Social Security Disability. If you, and your treating doctors, believe that your injury/illness will not allow you to return to your previous work an application for Disability Retirement should be filed.

NYCERS has an established “Medical Board” to hear each application for disability retirement. This three doctor panel is charged with reviewing all the evidence a member submits in support of their claim for benefits and is also required to psychically examine the injured/ill worker. Once examined, the Medical Board will “recommend” to the NYCERS governing body, the Board of Trustees, whether to approve or deny your claim. By law the Board of Trustees cannot overturn the Medical Board’s determination regarding a member’s fitness for duty, but must make its own determination on issues regarding the “accidental” nature of your injury and “causal relationship”, that is, whether your injury was caused by the specific accident alleged in the application.
