POPULAR HARDWARE CHAIN EMPLOYEE WINS SETTLEMENT – MDASR LLP, NASSAU COUNTY, New York.

September 2025

Local Syosset man working at a popular hardware chain-store in Nassau County suffered a work-injury that led to 4 years of medical treatment, unemployment, and court hearings before eventually settling in 2025. Luckily, he chose McIntyre, Donohue, Accardi, Salmonson & Riordan LLP as his Nassau County Workers’ Compensation lawyers.

The injured client suffered a work-related injury while sorting and carrying heavy pallets packed with merchandise. The client and their coworker were lifting the merchandise-filled pallet when the coworker lost grip and let go of the pallet. As it fell, MDASR’s client recoiled and tried to stop the pallet from hitting the floor, injuring his shoulders and elbows. Almost immediately after the pallet was dropped the client felt an intense pressure and pain radiating from the shoulders and elbows. Like most work-accidents the initial injuries led to other medical issues.

Fortunately, MDASR LLP. was able to get medical treatment covered by the employer’s Insurance Carrier in addition to securing weekly compensation benefits while their client was out of work due to his work-injury.

Securing weekly benefits is an important but tricky step in a Workers’ Compensation Case. Although rare, an employer’s Insurance Carrier will voluntarily pay an injured employee a portion of their average weekly earnings if they cannot work due to a work-related injury. Unfortunately, in most cases insurance carriers avoid paying an injured worker, leaving employees at risk of losing their income, their job, and most importantly their health.

MDASR Attorney Lisa Salmonson was able to put this case in front of a judge and request to have the Insurance Carrier and Employer produce their client’s payroll documentation. The judge ruled in the favor of MDASR LLP, leading to the employer releasing the claimant’s payroll information. Once produced, in addition to Medical Reports retrieved by MDASR LLP— The law firm was able to lock in weekly benefits and get any time-lost reimbursed at a total rate.

After months of treating, they learned that the initial injuries led to other medical problems that required surgical intervention. When issues with the Neck and Back came up it was quickly concluded that the shoulder injury led to other issues in the surrounding areas, such as the thoracic & cervical vertebrae. The client was able to get medical documentation attributing the consequential Neck and Back injuries to the work accident. This meant the Workers’ Comp attorneys at McIntyre, Donohue, Accardi, Salmonson & Riordan LLP were able to request a hearing with the Workers’ Compensation Board and add the neck & back as injuries to this comp case. Adding those body sites to the case allowed for the firm to successfully request surgery and get it paid for by the employer’s insurance carrier.

In the case of this injured worker, the team at MDASR LLP were able to secure weekly payments while their client was out of work, medical treatment to ensure a safe return to the labor market, and peace of mind knowing the top Hurt-at-Work attorneys in New York are protecting their rights & securing their future. Once the client’s doctors concluded that he’s reached maximum medical improvement the attorneys at MDASR LLP stepped in to action and made sure to settle this case with a final settlement award of $233,130.
