L.I HOSPITAL EMPLOYEE ASSAULTED BY PATIENT WINS SETTLEMENT – MDASR LLP, Long Island, New York.

A local Long Island Nurse Assistant that works at one of the longest standing hospitals on the South Shore recently won and reached a settlement with the Insurance Carrier in their Workers’ Compensation case. The Law offices of McIntyre, Donohue, Accardi, Salmonson & Riordan LLP. were proud to represent this nurse assistant which ultimately led to a settlement award upwards of $140,000 going directly to our client. Although we take pride in being able to get our client the compensation they deserved, this case shows the everyday reality of daily risks faced by workers, specifically in the healthcare industry.
This local nurse assistant was assaulted by their own patient during a routine shift at their workplace. The nurse assistant was caring for a patient when the patient began to pull on the IV needle that was tugging on a major vein in the leg. When the nurse assistant attempted to stop the patient, they became combative. Once the patient showed signs of aggression the nurse assistant realized this was going to take team intervention. In order to notify the rest of the floor of the situation the nurse assistant turned their back to the patient and ran towards the door. Before the nurse could even make it out of the hospital room, they were struck from behind and knocked unconscious.
The nurse assistant sustained serious injuries and remained out of work. They were left to use their personal & sick time to cover the costs of being out of work. With sick/personal time running out, and a significantly hard time getting a prompt appointment with a Workers’ Comp coded doctor, they turned to us– McIntyre, Donohue, Accardi, Salmonson & Riordan LLP.
