How to File a Workers’ Compensation Claim in Manhattan

  1. Report the Injury: Notify your employer within 30 days of the accident, making sure to include the date, time, witnesses, and what happened during the incident.
  2. Seek Medical Treatment: Obtain medical care by an authorized medical certified provider with the New York State Workers’ Compensation Board (WCB) to ensure proper care was taken. Make sure you notify the medical personnel that this is a work-injury immediately. This should prompt the medical provider to bill your employer and not your private insurance. Requesting copies of Medical Reports/Notes is always recommended.
  3. Complete Form C-3: Complete your Employee Claim (Form C-3) and submit to the Workers’ Compensation Board within 2 years of the accident to be eligible for Workers’ Compensation benefits.
  4. Follow Up: After submitting your Employee Claim, your employer and insurance carrier will start investigating the claim. They will review your medical records and conduct an Independent Medical Examination (IME) if it is deemed necessary.
