Starting this December 2024, the New York Workers’ Compensation Board is introducing a faster process for handling claims involving new or related injuries for workers already injured.
When a lawyer submits a form with medical evidence for an unrecognized injury, the board will issue a proposed decision to speed up the case. Insurers have 30 days to respond.
If the insurance carrier agrees with the decision, they notify the board.
If the insurance carrier doesn’t agree, they have 60 days to either conduct an independent medical exam or question the worker’s doctor.
In conclusion, this new process aims to resolve claims more quickly and fairly.
