Workers’ Comp Benefits for Injured Workers

Workers’ Compensation claims are not a lawsuit. They are a claim on an insurance policy that is held by your employer. As an employee you are entitled to be covered under that insurance policy. The main purpose of said policy is to provide:

Medical Coverage: Workers’ compensation offers medical coverage for expenses related to your work-injury. From office visits to operative procedures, the insurance carrier is responsible for covering all costs for medical treatment regarding your injury. The goal is to treat the injury until a doctor finds that it has reached maximum medical improvement. Maximum Medical Improvement means your doctor has exhausted all treatment options and considers your injury to be as healed as it will ever be.

Example: A Construction Worker for a contracting company in Nassau County suffers a broken leg and fractured hip after falling from a high altitude. The insurance carrier is responsible for covering all costs starting from the ambulance ride to the hospital, examinations, x-rays, surgeries, rehabilitation, physical therapy, down to medicine prescribed by your doctor.

Lost Wages/Wage Replacement: In the event a work-related injury prevents an employee from working, the insurance carrier is responsible for compensating by providing weekly compensation checks. The out-of-work employee will receive a portion of their average weekly wage. Average Weekly Wage is how much you would regularly earn in a week spanning a year back from the date of injury. Insurance carriers are known to avoid paying their claimants. It is up to the claimant to provide proof of their income and medical reports/documentation indicating a doctor is keeping them out of work. The purpose of Workers’ Compensation benefits is to assist the claimant financially until they can return to work.

Example: A registered nurse working in a Nassau County Hospital suffers a severe injury that keeps them out of work. The insurance carrier is prompted to start paying weekly compensation payments once they receive medical proof that they are not able to return to work. It is up to the registered nurse to regularly follow up with their doctor to ensure the Workers’ Compensation Board & Insurance Carrier are receiving up to date medical reports.

Yes. Workers’ compensation is a no-fault system in New York, meaning you’re typically eligible for benefits regardless of who caused the accident—as long as it occurred during the course of your employment.

You may be entitled to medical treatment, wage replacement benefits, and compensation for permanent injuries. Our attorneys will help ensure you receive the maximum benefits allowed by law.

You have the right to appeal. MDASR, LLP will represent you at hearings before the Workers’ Compensation Board and work to overturn the denial and secure the benefits you deserve.

It all depends on the percentage of disability. Typically, the severity of the injury decides how long someone can receive benefits. The more injured an employee is, the longer they can receive benefits. For example, if a doctor finds you 100% permanently disabled you are therefore entitled to lifetime benefits.

  1. What if my employer doesn’t carry workers’ comp?

In New York State, all employers are mandated to have Workers’ Compensation insurance. Unfortunately, many employers neglect to do so…leaving their employees at risk. Fortunately, in New York there are systems in place to assist in these cases. In these cases, you or your attorney will need to produce evidence and mediate action in front of the Workers’ Compensation Board in order to qualify for the Uninsured Employer sector of Workers’ Compensation.

Workers’ Compensation benefits can be denied for the following reasons:

  • Lack of medical evidence/reports.
  • Claim filed with wrong Insurance Carrier.
  • Employer is denying an injury happened or is work-related.
  • Injury was not reported within 30 days.
  • Insurance Carrier is raising fraud.
  • Update/correct any issues with your first claim & refile.
  • Appeal the denial and request a hearing with the Workers’ Compensation Board.
  • Retain a Hurt-At-Work attorney.

No, once you are out of work due to an injury you cannot go back to work until a doctor medically clears you to return-to-work and perform your duties. It is important to know that your doctor might clear you for work with restrictions or light-duty, limiting your capability of performing.

Legally, no. However, this does not stop employers from finding ways around Workers’ Comp guidelines to fire an employee that has an open compensation claim.

There is no direct answer to this. Different divisions handle different forms of investigations in a Workers’ Compensation case. Overall, investigations and appeals can take up to a year depending on the matter.

Depending on the subject matter of the investigation they could be looking at eye-witnesses, medical reports, proof of income, video evidence, doctor testimony, etc.

Decisions made by the Workers’ Compensation Board can be appealed. You have 30 days from the filing date of a decision to file an appeal with the Workers’ Compensation Board.
