How to file a Workers’ Compensation Claim in New York State

Step 1: Report the Injury

Notify your employer within 30 days of the accident, making sure to include the date, time, witnesses, and what happened during the incident.

Step 2: Seek Medical Treatment

Obtain medical care by an authorized medical certified provider with the New York State Workers’ Compensation Board (WCB) to ensure proper care was taken.

Obtain the medical care you need for your work-related injury. Make sure you notify the medical personnel that this is a work-injury immediately. This should prompt the medical provider to bill your employer and not your private insurance. Requesting copies of Medical Reports/Notes is always recommended.

Step 3: Complete Form C-3

Complete your Employee Claim (Form C-3) and submit to the Workers’ Compensation Board within 2 years of the accident to be eligible for Workers’ Compensation benefits.

Step 4: Follow Up

After submitting your Employee Claim, your employer and insurance carrier will start investigating the claim. They will review your medical records and conduct an Independent Medical Examination (IME) if it is deemed necessary.

Workers’ Compensation Benefits for Injured Workers in Suffolk County, Long Island

What benefits does New York State Workers’ Compensation provide to injured workers?

Workers’ Compensation covers all of the necessary medical expenses that relate to the workplace injury, including doctor visits, hospital stays, imaging, examinations, physical therapy, surgery, and medical testing.

Workers’ Compensation Benefits can replace up to Two-Thirds (2/3) of your Average Weekly Wage for lost time due to work-related injuries.

If a doctor finds that work-related injury deems you unable to return to work, you may be entitled to Permanent Disability Benefits.

What makes you a qualified candidate?

Your injury must have occurred while working for your employer.  This applies whether you are a full-time, part-time, leased, or seasonal worker.

Under New York Labor Laws & Workers’ Comp Guidelines, as an employee you have 30 days to report an incident to your employer.  Although it is preferred on a written/formal complaint – verbal & co-worker testimony can help prove a claim.

Reporting an injury to your employer DOES NOT automatically file a Workers’ Comp claim.  After reporting, you have up to two years to file your claim with the Workers’ Compensation Board.
