How A Workers’ Compensation Lawyer in Suffolk County Can Help
Although employers are required to have Workers’ Compensation Insurance, they are not so eager to use it. Many claims are minimized or denied to ensure your employer and insurance carrier are not liable for your medical treatment and/or compensation.
Your employer has attorneys whose priority is saving themselves money; our priority is your health and well-being. McIntrye, Donohue, Accardi, Salmonson, & Riordan LLP has the expertise to assist in a wide variety of compensation claims. Our staff will ensure we:
- Take Action Immediately – This is important to ensure that the proper New York State deadlines are met so you don’t lose your rights.
- Search and Organize Your Evidence – Obtaining Medical Records, Accident Reports, Pay Records, etc. is crucial to ensure your claim is accepted with no issue. This also helps us obtain weekly payments if you’re Out-Of-Work, and medical treatment if it’s being denied by your employer’s insurance carrier.
- Representing YOU – Retaining the services of McIntrye, Donohue, Accardi, Salmonson, & Riordan LLP means you will have access to an entire staff of dedicated paralegals ensuring your safe return to work and the benefits you deserve. You will be represented by a team of award-winning attorneys that specialize in Workers’ Compensation.
Third Party Claims
Third Party Claims are legal claims against non-employers, such as contractors, manufacturers, or property owners, who may have contributed to your workplace injury. Injuries from construction site accidents, defective machinery, unsafe property conditions, or vehicle collisions while on the job are all examples of third-party claims that fall under workplace injuries. Beyond Workers’ Comp benefits, you may recover damages for pain and suffering, full wage replacement, medical costs, and future lost earnings.
At McIntrye, Donohue, Accardi, Salmonson, & Riordan LLP, we handle both Workers’ Compensation and Personal Injury claims to ensure seamless representation and maximize your recovery.
How to file a Workers’ Compensation Claim in New York State
Step 1: Report the Injury
Notify your employer within 30 days of the accident, making sure to include the date, time, witnesses, and what happened during the incident.
Step 2: Seek Medical Treatment
Obtain medical care by an authorized medical certified provider with the New York State Workers’ Compensation Board (WCB) to ensure proper care was taken.
Obtain the medical care you need for your work-related injury. Make sure you notify the medical personnel that this is a work-injury immediately. This should prompt the medical provider to bill your employer and not your private insurance. Requesting copies of Medical Reports/Notes is always recommended.
Step 3: Complete Form C-3
Complete your Employee Claim (Form C-3) and submit to the Workers’ Compensation Board within 2 years of the accident to be eligible for Workers’ Compensation benefits.
Step 4: Follow Up
After submitting your Employee Claim, your employer and insurance carrier will start investigating the claim. They will review your medical records and conduct an Independent Medical Examination (IME) if it is deemed necessary.
Step 5: Consult with MDASR
McIntrye, Donohue, Accardi, Salmonson, & Riordan LLP will make sure you complete everything needed within a timely manner, and one of our attorneys will be ready to represent you with your Workers’ Compensation case. If you have any questions or concerns, call for a FREE consultation today at (866)557-7500.
