Your employer has attorneys whose priority is saving themselves money; our priority is your health and well-being. McIntyre, Donohue, Accardi, Salmonson, & Riordan, LLP has the expertise to assist in a wide variety of compensation claims. Our staff will ensure we:
- Take Action Immediately: This is important to ensure that the proper New York State deadlines are met so you don’t lose your rights.
- Search and Organize Your Evidence: Obtaining Medical Records, Accident Reports, Pay Records, etc. is crucial to ensure your claim is accepted with no issue. This also helps us obtain weekly payments if you’re Out-Of-Work, and medical treatment if it’s being denied by your employer’s insurance carrier.

How to File a Workers’ Compensation Claim in New York State
- Report the Injury: Notify your employer within 30 days of the accident, making sure to include the date, time, witnesses, and what happened during the incident.
- Seek Medical Treatment: Obtain medical care by an authorized medical certified provider with the New York State Workers’ Compensation Board (WCB) to ensure proper care was taken. Make sure you notify the medical personnel that this is a work-injury immediately. This should prompt the medical provider to bill your employer and not your private insurance. Requesting copies of Medical Reports/Notes is always recommended.
- Complete Form C-3: Complete your Employee Claim (Form C-3) and submit to the Workers’ Compensation Board within 2 years of the accident to be eligible for Workers’ Compensation benefits.
- Follow Up: After submitting your Employee Claim, your employer and insurance carrier will start investigating the claim. They will review your medical records and conduct an Independent Medical Examination (IME) if it is deemed necessary.

“Ethel DeHoyos, my pension paralegal, has been wonderful. She guided me throughout the entire process and made it easy. You can’t find a more competent and personable individual. She was friendly, easy to talk to, and always promptly returned my calls and emails, unlike the paralegal at my previous law firm. My attorneys at MDASR (Chet Lukaszewski, Joseph Abrahams, and Ron Schnepf) have also been top-notch. Their results speak for themselves.
I wholeheartedly recommend the law firm of McIntyre, Donohue, Accardi, Salmonson & Riordan (MDASR) to anyone who is unfortunate to require legal representation for their Workers’ Compensation, Social Security Disability, or Civil Service pension case. You won’t be disappointed.
