“Bill would provide claimants permanent disability for ‘extreme’ financial hardship”

New York lawmakers are reviewing A.B. 3723, which aims to amend workers’ compensation law. The bill would allow certain injured workers to be reclassified as having permanent total disability if they face “extreme hardship.”
Key criteria include:
Income from Social Security disability and pensions falls below 50% of the worker’s average weekly wage after losing partial disability benefits.
Inability to meet basic living expenses for themselves and dependents.
New medical, functional, or vocational issues reducing earning capacity.
Income dropping below federal poverty guidelines post-benefits.
Also under review is A.B. 3890, providing extra disability payments to transit workers injured in violent attacks.
